July 2018 UBE Predictions: Are you wondering what might be tested on the July 2018 Uniform Bar Exam (UBE)? We are too! We have created our own July 2018 UBE predictions. Below are the essay subjects and MPTs that we think are coming up, primarily based on past MEE and MPT questions.
Update: This post is being updated with what, upon information and belief, was tested on the July 2018 UBE. We will update it again once the questions are available for review by the National Conference of Bar Examiners.

July 2018 UBE Predictions
While we are not always correct in our predictions, we are usually fairly close! See our February 2018 MEE predictions to see how we accurately guessed the majority of subjects tested!
Disclaimer: You should NOT solely rely on these predictions when you study! You should study all subjects when preparing for the MEE exam. All of the subjects are fair game.

We think you may see the following subjects on the July 2018 UBE.
July 2018 UBE Predictions: Multistate Essay Exam (MEE)
1. Civil Procedure – NOT tested.
Civil Procedure remains the most highly tested subject on the MEE! Therefore, we think it is coming up! The Examiners did not test Civil Procedure in February 2017, but they did test it in July 2017 and February 2018. When Civil Procedure has been tested, it is usually tested consistently for at least several administrations. Note now that Civil Procedure has been added to the MBE portion of the test, we think it will be tested less frequently on the essay portion of the exam in upcoming administrations. We think this last note is especially important – since Civil Procedure was added to the MBE in 2015, we think it will show up less and less on the MEE!
2. Constitutional Law – Tested!
Constitutional Law has typically been tested every other exam since February 2012. As Constitutional Law was last tested in July 2017 we think it possible that it may be tested in July 2018. The Constitutional Law questions tend to be tricky, so make sure to review past questions carefully (e.g., in July 2017 the question tested the dormant commerce clause and sovereign immunity).
3. Corporations and LLCs – Tested!
Corporations is also commonly tested on the MEE. Since February July 2011 the Examiners have generally tested Corporations every other administration. Corporations was not tested on the last two exams so it is ripe for testing! Don’t forget to review the rules pertaining to LLCs as the Examiners have tested this entity several times on past exams. Many of the rules regarding LLCs overlap with corporations, but some of them do not!
4. Secured Transactions – Tested (we believe this was combined with Real Property; however, since we have not seen the questions, we cannot say for sure. We have heard mixed reviews!)
We think that Secured Transactions might be coming up! In recent years it has become a more popular subject for testing. It was not tested on the last exam, so that makes it more likely for July. One commonly tested issue is priority, so take some time to review rules concerning the priority of different types of creditors.
5. Torts & Agency – NOT tested.
The Examiners often like to alternate between Contracts and Torts on the exam. As Contracts was tested on the February 2018 Exam, it is likely that Torts will appear on the July 2018 exam. We would not be surprised if Torts were tested in conjunction with Agency – this last happened in July 2013 and February 2015. Further, Agency was not tested on the February 2018 exam. So make sure to review both Torts as well as Agency!
6. Trusts (but also review Decedents’ Estates – see note below!) – Tested!
Typically the Examiners take turns testing Decedents’ Estates and Trusts. Occasionally, they don’t test either of these subjects on the exam (as was the case in February 2018). Given that it was not tested on the last exam, it makes it more likely that one of these subjects will show up. Since February 2011, Wills and Trusts have been tested equally – five times. And the sixth time these subjects were tested, they appeared in a crossover essay. We don’t expect to seem these tested in a crossover essay again so soon. It is more likely you will see one of these subjects in a stand-alone essay. Thus, we suggest reviewing both of these subjects carefully.
Wild Card: Real Property – Tested!
Real Property was just tested in February 2018, but we wouldn’t be surprised if it were tested again this July. It was last tested in consecutive administrations in July 2011 and February 2012. Further, sometimes when Real Property has been tested, the Examiners focused heavily on class gifts, and this can either be classified as a Trusts or Real Property issue. Real Property was tested!
In determining our wild card subject we were also considering Evidence as a possibility. Evidence is one of the Examiners’ favorite subjects and has been tested on three of the five most recent administrations. And the last two times that Evidence was tested it was crossed over with Criminal Law and Procedure. Given that evidence was tested more frequently than Real Property on recent exams, we settled upon Real Property. However, we strongly recommend that you don’t discount evidence as you are studying for the exam! As it turns out, Evidence was tested too!

Note: We want to emphasize that you should not rely on these predictions! You should still study all of the subjects and focus on the most highly tested topics within each subject. We are simply letting you know what we think could be coming up on the July 2018 MEE.
July 2018 UBE Predictions: Multistate Performance Test (MPT)
If you are wondering what tasks you might be asked to complete on the MPT this July, here are our thoughts. Generally, the Examiners want to see whether students can write both objectively and persuasively, usually you will see one objective task and one persuasive task.
1. Persuasive Brief – Tested!
The objective memo and persuasive brief account for at least 70% of all tasks tested during the last ten years. For the February 2018 administration, both were tested. We think it is highly likely that examinees will be asked to complete one of these tasks. Since February 2013 students were asked to write an objective memo ten times and a persuasive brief six times. Thus, our best guess is that examinees will be asked to write a persuasive brief in July.

2. A Letter – Not tested! (A “wildcard” task was tested instead.)
After the objective memo and the persuasive brief, the next most commonly tested tasks are opinion letters and demand letters. We think that if you are asked to complete a memo or a brief for one of the tasks, the other task will most likely be a letter – either a demand letter or an opinion letter. Opinion letters are generally written to clients and provide an objective view of the possible courses of action available to them. Demand letters generally ask the recipient of the letter to take particular action, thus it is a persuasive task. Note: We want to emphasize that you should not rely on these predictions! You should take the time to review all of the commonly tested tasks on the MPT in addition to a few uncommon tasks.
