Below we discuss the accuracy of JD Advising’s February 2018 MEE Seminar predictions. We also note which issues surprised us! Overall, we are please to report that many of our predictions for the February 2018 Uniform Bar Exam were completely accurate.

February 2018 MEE Seminar Predictions: MBE Subjects
Civil Procedure
Until recently, the Examiners tested Civil Procedure on every exam! This time was no different- we predicted that Civil Procedure would show up and it did. However, the primary issue tested in this question – sanctions – was surprising! Sanctions are not a highly tested issue and it was just tested in February 2014.
Contracts
We did predict that Contracts would be tested and indeed, there was a Contracts question on the exam. We predicted half of the issues, including contract formation, whether UCC or common law governs, and how to modify a contract under common law. The other issue tested in the contracts essay was the parole evidence rule. We did not predict this issue because it has not been tested in any contracts essay.
Criminal Law and Procedure
We told our seminar students that it was highly likely that they would see a pure criminal law question, as criminal law had not appeared since July 2015. In addition, we predicted one of the two main issues tested, namely whether a defendant can be found not guilty by reason of insanity. We emphasized to our students that they should memorize the M’Naghten rule.
Real Property
Although Real Property was not on our formal list of predictions we told our students that Real Property would not surprise us at all if it were on the exam! In fact, we predicted almost all of the issues that showed up in the Real Property essay, including breach of the present covenants in a warranty deed, easements, and notice of an easement. All of these issues were up for testing, as they had not appeared on the essays since July 2011.
February 2018 MEE Seminar Predictions: MEE Subjects
Family Law
We did predict that Family Law would be on the exam and it did appear on the MEE. In fact, in our seminar, we covered almost all of the issues that showed up in this question, such as the validity of premarital agreements, whether marital fault is a bar to child custody, spousal support, and the division of marital and separate property.
Partnership
We told the seminar attendees to be on the look out for a partnership essay. Indeed, there was a full essay question on partnerships. We predicted all of the issues in the partnership essay, namely, withdrawal, breach of a fiduciary duty, and how to wind up a general partnership.
On the whole, our seminar students were at an advantage going into the February 2018 Uniform Bar Exam as we predicted issues in every essay question except for one! For the Contracts question and the Criminal Law and Procedure question, we accurately predicted at least half of the issues tested. And for some essays – such as Partnership, Family Law, and Real Property – we predicted almost all of the issues. Thus, our seminar attendees had the upper hand on almost every question!
