Is Michigan Adopting the Uniform Bar Exam (UBE)?
So far, numerous states have adopted the UBE. (To see the list of jurisdictions that have adopted the UBE, click here). The UBE is a relatively new test—the first jurisdiction to adopt it was Missouri, which adopted it for the February 2011 exam.
A big step for the UBE was when New York announced it would begin administering the UBE for the July 2016 New York bar exam. Other states tend to follow in the footsteps of New York, and New York’s adoption certainly did lead to more states considering adopting the UBE.
Another big step occurred in February 2016, when the American Bar Association urged all states to adopt the UBE. Since then, Vermont, South Carolina, and the District of Columbia announced the adoption of the UBE.
However, despite these large strides for the UBE, some very notable states, such as California, Texas, and Florida have declined to adopt the UBE. California recently reevaluated its bar exam and announced it would be changing its bar exam (and making it a two-day rather than a three-day exam) but it did not adopt the UBE when it reevaluated its bar exam.
Michigan is still not yet publicly talking about adopting the UBE as of this writing.
What is the Uniform Bar Exam?
The uniform bar exam tests “uniform” law, rather than any specific state’s law. It is composed of the multistate bar exam (MBE), which is a 200-question multiple-choice exam, the multistate essay exam (MEE) which is composed of six essays that test “multistate” law, and the multistate performance test (MPT) which tests your ability to complete a lawyerly task.
