Are you wondering whether you should apply for testing accommodations for the MPRE and (and later on, the bar exam)? This post will give an overview of what accommodations you can request, what you need in order to apply, and the different processes for getting MPRE testing accommodations.

What are Testing Accommodations?

Under the Americans with Disabilities Act (ADA), students with disabilities are entitled to receive reasonable accommodations when taking the MPRE.  In these instances, a disability is broadly defined as any condition that substantially limits one or more life activities. This covers physical disabilities, learning disabilities, and mental health concerns. Temporary disabilities such as short-term injuries also count. If you believe you have a disability, and you have the appropriate medical documentation, you can and should apply for testing accommodations.

So, what kind of accommodations are available for students who might need one?  You can request any accommodation you think would help you better access the test, provided that such accommodation is reasonable. Some examples include extra testing time, special technology, breaks during testing, or being able to bring medication to the test with you.

How to Apply For MPRE Accommodations

MPRE accommodations are handled by the National Conference of Bar Examiners.  You can apply for MPRE accommodations through your NCBE account!

What About the Bar Exam?

Each state handles its own requests for bar exam accommodations. The process and requirements are different for each state, so be sure to check the state bar’s website for exactly what you’ll need and make sure you allow yourself enough time to complete the process.

What You’ll Likely Need

In most cases, it’s necessary to provide medical documentation to show your need for any reasonable accommodation. There may be specific forms that your doctor has to fill out. It may also be helpful to have a history of past testing accommodations. If you can show that you had similar accommodations on the SAT, the LSAT, and throughout law school, you’re more likely to be granted those accommodations on the MPRE and the bar exam. Finally, some states ask you to write a personal narrative before granting a testing accommodation. For the MPRE, this step is optional.  If you decide to write the narrative, be sure you can clearly articulate why the accommodations you are requesting are necessary for you to succeed on the MPRE.

Pay Attention to Deadlines

Take note of any deadlines, and be sure to stay well ahead of them! For the MPRE, the NCBE takes at least 25 business days to process accommodation requests.  While you are waiting on the NCBE’s determination, you won’t be able to register for your test date and location.  When requesting an accommodation for the bar exam, the process can take even longer!

Remember that your request for accommodations may be denied. If that happens, there is usually an appeals process you can follow. This is yet another reason to request accommodations as early as possible; you want to have plenty of time to file an appeal if necessary.
