MPRE Difficulty: How Difficult is it to Pass the MPRE? I think one of the most common “law school myths” I keep hearing is that the MPRE is “super easy.” And that “you don’t have to study for the MPRE.” I often encounter students who have fallen victim to this awful advice (if that is that you want to call it). I am not saying that the MPRE is impossible. Or that it requires months and months of study. However, it does require SOME study and preparation.

In order to pass the MPRE, the questions require that you strike a balance between common sense, an understanding of the Model Rules of Professional Conduct and the Model Code of Judicial Conduct. It also requires you understand what, exactly, the questions are asking of you. You might be thinking, “Duh!” But—before you stop reading this blog post—let me explain that I am frequently astounded at the number of student that I encounter who admit to not studying the Rules or Code prior to the exam. The take away here: you should study the Rules and Code. That will dramatically increase your chances of passing the MPRE on the first try.
According to the National Conference of Bar Examiners (NCBE), the body that writes and administers the MPRE, it states that the exam tests the Rules and Code well as “. . . controlling constitutional decisions and generally accepted principles established in leading federal and state cases and in procedural and evidentiary rules.” So what does this mean to you? This means that you should get your hands on a good MPRE outline! You can read the rules and the code. And you can understand how these are interpreted. Doing released practice problems are another good way to test your ability to apply the material.
For most students, so long as they take the time to learn the Rules and Code and practice problems, they will fare just fine on the MPRE. If you want to better your chances of not having to take the exam for a second time, you should look into a course or private tutoring.
The MPRE is not impossible, but the MPRE is a hard exam. We should work together to change the myth that the exam is “easy.”
