Five Benefits Of Real MBE Questions
1. The style is most similar to what you will see on the exam.
All MBE questions have a similar writing style. For instance, they don’t use proper names. They don’t refer to specific states when referring to a state in a question. MBE questions break up the fact pattern into small, manageable paragraphs. They separate the call of the question from the rest of the fact pattern. Becoming comfortable with this structure and style will make the transition from practice questions to actual exam questions much smoother! As you take the exam, exposure to very similar practice questions should make you feel like you can answer the exam questions as this is something that you have already done hundreds of times in practice!
Although the NCBE writes all of the MBE questions, note that it does not format all the old questions like modern questions. Some of the older questions are formatted differently (e.g., proper names, the call of the question is not a complete sentence, etc.). If you are using older MBE-released questions to practice, be sure to find them from a company that reformats those questions so that they match the current format style!

2. The difficulty generally matches the difficulty of the actual exam.
The questions you will find from many commercial courses tend to be written by those commercial courses. They also tend to be more difficult than the actual MBE questions. You may think that that is a good thing. Better to be over-prepared than have practice questions be too easy, right?
The problem that some students face after doing more difficult practice questions is that they overthink the actual questions and miss them because they overlooked the obvious answer (which ends up being the correct answer!). This is not to say that actual MBE questions are easy, but we think using actual MBE questions as you practice will get you in the habit of answering the questions without starting to overthink your answer choices!
3. You will see how the NCBE tests certain areas of the law.
The NCBE has provided a breakdown of how frequently sub-topics within each subject are tested on the MBE. If you are using released MBE questions, you will likely see these sub-topics come up with a similar level of frequency as they will appear on the actual exam.
In contrast, many commercial course students report that they see extremely difficult areas of the law (e.g., future interests, rule against perpetuities) come up again and again on practice questions. The topics are undoubtedly very difficult, so the extra practice is meant to give you a better chance at learning those topics and becoming more comfortable with those difficult topics. However, looking at the frequency chart, Ownership of Real Property is only about 20% of the Real Property questions (which equates to 5-6 questions), and that sub-topic includes present and future interests, cotenancy, landlord-tenant law, and other special problems associated with ownership.
That means you might see 1-2 questions about future interests and RAP on the exam. With these very difficult topics making up such a small portion of the total points available, it is not worth spending a ton of time practicing them, when you could be practicing things that show up more frequently! So, using released MBE questions will help you allocate your time appropriately!
4. You will start to see patterns that will be replicated on the exam.
Sometimes there are keywords or triggers in the answer choices. These can help you determine if an answer choice is good or bad. For instance, watch out for the words “unless” and “if” because these words in an answer choice essentially change the fact pattern. You have to re-evaluate which answer is best in light of the facts that follow the qualifying word. Similarly, you may see words like “only” and “always” in answer choices that are very often too strongly-worded to be correct.
Released questions will expose you to this language and these patterns that show up again and again on MBE questions. You will be able to utilize these tricks and patterns to increase your score on the actual exam!
5. You will feel more confident walking into the exam!
After doing hundreds of released MBE questions in practice, you will be able to walk into the exam and tell yourself, “I have done this hundreds of times already, so I can do this again!” This will (hopefully) reduce any anxiety you may be feeling about what to expect on the exam. You should know exactly what to expect as you have reviewed, practiced, and studied actual released questions.
