MEE Frequency: Which Topics Are Tested the Most?
Understanding MEE frequency in terms of how often subjects and topics are tested can be highly beneficial to your studying! Considering the vast amount of material that is fair game on the MEE, preparing for the exam is all about studying smart. You need to use your time efficiently. Spending hours upon hours on a subject not likely to come up is not the best use of your time! When you learn MEE frequency patterns, you can make sure that you prioritize the highly tested topics, giving yourself the best chance for success.
MEE Frequency: Which Topics Are Tested the Most?
In this post, we list the subjects that are most frequently tested on the MEE and list some favorite topics within those subjects. For a more in-depth discussion of these highly tested rules, we strongly recommend our MEE one-sheets, which present these rules in greater detail on one page per subject! Also, check out this post on highly tested MEE topics, which contains a link to a pdf and video with our tips on how to pass the MEE! You can also check out our Uniform Bar Exam frequency chart here.
MEE Frequency: Which topics are tested the most:
1. Civil Procedure
When studying MEE frequency, it is impossible to miss that Civil Procedure. It is the most commonly tested subject across the last 16 bar exams. It has appeared 12 times on the MEE administered in Uniform Bar Exam jurisdictions. However, when looking a little deeper, it is also apparent that the subject is appearing less frequently of late. Now that Civil Procedure is being tested on the MBE, it is possible the Examiners feel less of a need to test it in an essay. Regardless, it is still a favorite, making it a subject you should devote plenty of time to.
Within the subject, pay specific attention to personal and subject matter jurisdiction, summary judgment under Rule 56, and temporary remedies (like injunctions). These topics appear far more often than others in civil procedure questions. Our MEE one-sheets cover all of these rules, and you can also check out our post Tips for Civil Procedure on the MEE for more details!
2. Contracts
Contracts has been appearing on the MEE more often lately. It’s important to mention in our review of MEE frequency. It has been tested on 9 of the last 16 UBEs, including 4 out of the last 5. Keep in mind that this subject includes sales as well, so there are plenty of different avenues the Examiners can take in testing this. The most commonly tested topics within contracts and sales include contract formation, rejection of goods vs. revocation of acceptance of goods, anticipatory repudiation vs. perspective inability to perform, and damages. Our Tips for Contracts and Sales on the MEE post and MEE one-sheets explore these topics further!
3. Agency and Partnership
Agency and Partnership is another MEE frequency favorite. Like contracts, it has shown up on 9 of the last 16 Uniform Bar Exams. However, this subject has been more spread out among exams, and if anything is appearing slightly less frequently. Additionally, the Examiners have been testing this subject (particularly agency) in connection with torts. This means that it is particularly important to understand these subjects and how their various rules intertwine. Our Tips for Agency and Partnership on the MEE blog post focuses on the requirements for an agency relationship, types of authority, and vicarious liability for agency, as well as the formation of a partnership and relations between partners. If you understand these topics, you have a great shot of doing well on an agency and/or partnership question!
4. Corporations and LLCs
Appearing on 8 of the last 16 UBEs, corporations and LLCs is an important topic to cover when analyzing MEE frequency. Like agency and partnership, it is relatively spread out over these 16 administrations. Unlike that subject, it is tested in isolation and hasn’t been combined with any other subject. The rules for corporations and for LLCs do overlap significantly, but it is necessary to understand the differences as well. Some of the favorite topics are the basics of incorporation, the basics of LLCs, fiduciary duties, and suits by and against shareholders. Review our Tips for Corporations and LLCs on the MEE post and our MEE one-sheets for more details on these rules!
5. Evidence
One final critical MEE frequency subject to mention is evidence. Evidence has appeared on 8 of the last 16 UBEs as well. However, 7 of those instances have been in the last 12 administrations. Evidence is another subject that the Examiners like to combine with other subjects. Twice during this time period, evidence was combined with criminal procedure. Thus, this is another subject that you need to be aware of regarding its connections with other rules. Some of the most popular topics include hearsay (far and away the most frequently tested topic), relevancy, impeachment, and character evidence. Again, make sure to look over our Tips for Evidence on the MEE post for more details, and look into purchasing our MEE one-sheets! They really do make a difference!
